Our Privacy Policy also governs your use of the Zabana Services and explains our practices.

When you use the Zabana Services or communicate with us electronically, you consent to receive electronic communications such as emails, texts, notices, and in-service messages. You agree that electronic agreements, notices, disclosures, and communications satisfy legal writing requirements.

Content made available through a Zabana Service, including text, graphics, logos, icons, images, audio, downloads, data, and software, belongs to Zabana or its suppliers and is protected by United States and international copyright laws.

Zabana graphics, logos, page headers, icons, scripts, and service names are trademarks or trade dress of Zabana. They may not be used in a way likely to cause confusion or to disparage Zabana. Other marks belong to their respective owners.

Subject to these conditions and applicable service terms, Zabana grants you a limited, non-exclusive, non-transferable, non-sublicensable license for personal, non-commercial access to the Zabana Services.

The license excludes resale, commercial exploitation, collection or copying of listings and account information, derivative use, data mining, robots, framing, hidden text, and unauthorized use of Zabana names or marks. All ungranted rights are reserved. The license ends if you breach applicable terms.

You may need an account and valid payment method for certain Services. You are responsible for keeping account credentials confidential, restricting access to your devices, and all activity under your account. Zabana products are intended for adults who may purchase using supported cryptocurrency.

You may submit reviews, photos, communications, ideas, and other content if it is lawful and does not infringe rights, threaten, defame, invade privacy, mislead, impersonate, or otherwise harm others. Zabana may remove or edit content but does not routinely review everything posted.

Unless stated otherwise, you grant Zabana a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable right to use, reproduce, adapt, publish, perform, translate, distribute, and display submitted content. You confirm that you own or control the necessary rights.

Zabana respects intellectual property rights. If you believe your rights are infringed, email contact@zabana.com.

Purchases of physical items are made under a shipment contract. Risk of loss and title pass to you when the item is delivered to the carrier, subject to applicable mandatory law.

Review the Return Policy for the applicable process. Zabana does not take title to returned items until they reach the return address. In some cases a refund may be issued without a return; Zabana then does not take title to the refunded item.

We try to be accurate but do not warrant that descriptions or other content are complete, reliable, current, or error-free. If a product sold by Zabana is not as described, the remedy is to return it unused in accordance with the Return Policy.

If an item is mispriced and the correct price is higher than displayed, we may contact you for instructions before shipping or cancel the order and notify you.

Software and related documentation provided with the Services belong to Zabana or its suppliers. You may use them only to access the Zabana Services as authorized and subject to applicable terms.

THE ZABANA SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, SOFTWARE, AND OTHER SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” UNLESS STATED OTHERWISE IN WRITING. YOUR USE IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, ZABANA DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND DOES NOT WARRANT THAT THE SERVICES ARE FREE OF HARMFUL COMPONENTS. ZABANA IS NOT LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EXCEPT WHERE LIABILITY CANNOT LEGALLY BE EXCLUDED.

Disputes relating to a Zabana Service will be adjudicated in the state or federal courts where Zabana is headquartered. You consent to exclusive jurisdiction and venue there, and each party waives the right to a jury trial where permitted.

Applicable federal law and the law of the state where Zabana is headquartered, without regard to conflict-of-law principles, govern these conditions and disputes between you and Zabana.

The Privacy Policy, Return Policy, and other posted policies also govern use of the Services. We may change the site, policies, service terms, and these conditions. If a condition is invalid or unenforceable, it is severed without affecting the remaining conditions.
